Wild Pines Marketplace
Last updated: October 2, 2026
Wild Pines Marketplace LLC ("Wild Pines," "we," "us," or "our") respects intellectual-property rights and expects marketplace users to do the same.
This Intellectual Property & DMCA Policy explains rules governing copyrighted works, trademarks, counterfeit merchandise, user content, intellectual-property complaints, and applicable notice-and-takedown procedures.
Wild Pines operates a user-content marketplace. Hosting a listing or acting on a report does not make Wild Pines the seller, owner, manufacturer, or guarantor of third-party merchandise, and does not constitute a determination of ultimate ownership except where law requires a particular action.
This policy forms part of the Wild Pines Terms of Service and Seller Agreement.
Sellers are responsible for ensuring that their listings, merchandise, photographs, descriptions, logos, graphics, packaging, and other content do not unlawfully infringe another party's copyright, trademark, patent, right of publicity, or other intellectual-property or proprietary rights.
The ability to upload content to Wild Pines does not mean Wild Pines has determined that the seller owns or is authorized to use that content.
Users may not upload, reproduce, distribute, display, sell, or otherwise use copyrighted material through Wild Pines without authorization when authorization is legally required.
This may include photographs, illustrations, artwork, written descriptions, videos, software, graphics, and other protected works.
Sellers should use photographs they created themselves or have lawful permission to use.
Copying photographs from another seller, manufacturer, retailer, photographer, website, marketplace, or other source may violate intellectual-property rights even when the seller lawfully owns the physical merchandise being offered.
Sellers should create original listing descriptions or use material they are legally authorized to use.
Facts about a product may generally be described, but users may not copy protected creative expression from another source when doing so would infringe applicable copyright law.
Users may not use another party's trademark in a manner that is unlawful, counterfeit, deceptive, or likely to create prohibited confusion concerning source, sponsorship, affiliation, or authenticity.
Sellers may accurately identify genuine branded merchandise where legally permitted, but may not falsely imply that the seller or Wild Pines is endorsed by, affiliated with, or authorized by the brand.
Counterfeit goods are prohibited on Wild Pines.
Sellers may not list replicas, imitations, unauthorized reproductions, or fake branded products as genuine merchandise.
Describing counterfeit merchandise as a "replica," "inspired," "dupe," or similar term does not make an otherwise unlawful product permissible.
Sellers are responsible for accurately representing the authenticity, origin, brand, model, and condition of merchandise.
Wild Pines may request receipts, serial numbers, photographs, authentication records, provenance information, or other reasonable evidence when authenticity is legitimately disputed.
Users are responsible for respecting applicable patent, design, publicity, privacy, trade-secret, and other proprietary rights.
Certain disputes involving these rights may require information or legal determinations beyond the scope of a standard copyright takedown process.
Except for user content and third-party material, the Wild Pines Platform and its original software, design, text, graphics, interfaces, arrangement, branding, and other proprietary content are owned by or licensed to Wild Pines Marketplace LLC and are protected by applicable intellectual-property laws.
No ownership interest in Wild Pines intellectual property is transferred to a user merely because the user accesses or uses the Platform.
Users may not use the Wild Pines Marketplace name, logos, branding, trade dress, or confusingly similar branding in a manner that falsely implies sponsorship, endorsement, partnership, or affiliation.
Nothing in this policy grants permission to register or claim rights in Wild Pines branding.
Users retain whatever ownership rights they otherwise possess in content they submit to Wild Pines.
By submitting content to the Platform, users grant Wild Pines the licenses described in the Terms of Service as reasonably necessary to host, display, reproduce, format, distribute, promote, operate, and provide the Platform and marketplace services.
A rights owner or authorized representative who believes content on Wild Pines infringes intellectual-property rights may submit a complaint to Wild Pines.
Complaints should identify the specific material at issue and provide enough information for Wild Pines to evaluate and locate the material.
A copyright owner or authorized representative seeking removal of allegedly infringing material should provide a written notice that includes the information required by applicable law.
A notice should include:
Intellectual-property complaints must be submitted in good faith.
A complaining party should consider whether the disputed use is authorized by the rights owner or otherwise permitted by applicable law before requesting removal.
Knowingly making material misrepresentations in an infringement notice may result in legal consequences.
When Wild Pines receives a sufficiently supported complaint, Wild Pines may investigate and may remove or disable access to the disputed content where appropriate.
Wild Pines may notify the affected user and may provide information concerning an available response or counter-notice procedure.
A user whose material was removed or disabled because of a qualifying copyright complaint may be able to submit a counter-notice where the user believes the material was removed because of mistake or misidentification.
A legally sufficient counter-notice generally includes:
Where applicable law permits restoration following a valid counter-notice, Wild Pines may restore material after the applicable statutory process unless the complaining party timely provides notice of qualifying legal action seeking to restrain the allegedly infringing activity.
In appropriate circumstances, Wild Pines may restrict or terminate accounts of users who repeatedly infringe intellectual-property rights.
Wild Pines may consider valid complaints, counter-notices, retractions, judicial determinations, user history, and other relevant circumstances when applying this policy.
Trademark owners may report listings or content they reasonably believe unlawfully infringes their trademark rights.
A trademark complaint should identify:
Brand owners, buyers, and other users may report merchandise reasonably suspected to be counterfeit.
Wild Pines may request information from the seller concerning authenticity and may restrict the listing or account while a credible complaint is evaluated.
Sellers must cooperate reasonably with legitimate intellectual-property and authenticity investigations.
Failure to provide reasonably requested information may result in listing removal or account restrictions when Wild Pines cannot adequately resolve a legitimate concern.
Users may not knowingly submit false intellectual-property complaints, impersonate a rights owner, fabricate registrations, or misuse the reporting process to harass competitors or other users.
Wild Pines may restrict access to reporting tools or take other appropriate action in response to demonstrated abuse.
Marketplace enforcement decisions are not necessarily judicial determinations concerning ultimate ownership or infringement.
Complex disputes may need to be resolved directly between the affected parties or through appropriate legal proceedings.
Wild Pines may preserve information concerning listings, transactions, complaints, notices, counter-notices, and affected accounts when reasonably necessary for enforcement, fraud prevention, dispute resolution, or legal compliance.
Wild Pines may disclose information concerning an intellectual-property dispute when required by valid legal process or otherwise permitted or required by applicable law.
Wild Pines may remove or restrict a listing when credible information indicates that the merchandise is counterfeit, infringing, unlawful, or otherwise prohibited under Wild Pines policies.
Depending on the circumstances, Wild Pines may issue warnings, remove content, restrict listings, suspend selling privileges, cancel affected transactions, or suspend or terminate accounts for intellectual-property violations.
Submission of a complaint does not automatically guarantee removal. Wild Pines may request additional information and may decline to act on a complaint that is incomplete, unsupported, outside the scope of the applicable process, or otherwise insufficient.
