Wild Pines Marketplace
Last updated: October 2, 2026
This Seller Agreement governs persons and businesses that list, sell, or attempt to sell merchandise through Wild Pines Marketplace.
Wild Pines Marketplace is operated by Wild Pines Marketplace LLC, a Colorado limited liability company ("Wild Pines," "we," "us," or "our").
By listing an item, accepting an order, receiving seller proceeds, or otherwise using Wild Pines as a seller, you agree to this Seller Agreement, the Wild Pines Terms of Service, Prohibited Items Policy, Shipping Policy, Buyer Protection Policy, Marketplace Rules, Privacy Policy, Intellectual Property Policy, and other policies applicable to the transaction.
Sellers using Wild Pines are independent third parties. Unless Wild Pines expressly identifies itself as the seller of particular merchandise, the Seller — not Wild Pines — is the seller of the merchandise offered through the Seller's listing.
Wild Pines operates the marketplace platform and provides marketplace services that may include listing functionality, checkout, payment facilitation, shipping tools, tracking, transaction records, Buyer Protection administration, seller payout functionality, and related platform services.
Unless expressly stated otherwise, Wild Pines does not own Seller merchandise and is not its manufacturer, distributor, importer, wholesaler, or supplier.
Wild Pines does not take title to, possession of, or responsibility for Seller merchandise merely because it hosts a listing, facilitates checkout, provides a shipping tool, displays tracking, or makes proceeds eligible under the Platform's stated process.
Sellers are responsible for their merchandise, inventory, listing information, pricing, legal authority to sell, product compliance, packaging, fulfillment, records, and Seller-specific legal and tax obligations, subject to Wild Pines policies and applicable law.
Wild Pines may charge marketplace, service, or other platform fees disclosed through the Platform. Seller merchandise proceeds are not characterized as Wild Pines' merchandise sales merely because Wild Pines or its payment provider processes the transaction or facilitates settlement to the Seller.
Nothing in this Agreement creates an employment, partnership, franchise, joint venture, fiduciary, or agency relationship between a Seller and Wild Pines. Nothing in this Section limits or transfers any obligation that applicable law independently imposes on Wild Pines as an online marketplace, marketplace facilitator, payment facilitator, or other regulated platform participant.
Sellers must provide accurate, current, and complete information requested by Wild Pines or its payment providers.
Depending on the Seller's activity and applicable law, this may include legal name, address, telephone number, email address, government-issued identification, taxpayer information, business information, beneficial-owner information, and bank or payout information.
Wild Pines may use third-party providers to verify Seller information. Sellers authorize reasonable verification necessary to administer payments, prevent fraud, protect marketplace users, and satisfy legal obligations.
Sellers must promptly update information that becomes inaccurate or incomplete.
Sellers whose marketplace activity reaches applicable statutory thresholds may become subject to additional information collection, verification, certification, disclosure, recordkeeping, and compliance requirements under the INFORM Consumers Act.
Sellers must provide accurate, current, and complete information reasonably requested by Wild Pines to satisfy applicable INFORM Consumers Act requirements and must cooperate with lawful verification procedures. Required information may include banking or payee information, taxpayer information, contact information, identification, business information, and other information required by applicable law.
Qualifying Sellers must respond within legally required timeframes to requests for required information, verification, updates, or certifications. Sellers must promptly notify Wild Pines when required information becomes inaccurate or changes.
Wild Pines may collect, verify, maintain, and disclose information as required to satisfy its own obligations under the INFORM Consumers Act and may use qualified payment processors or other service providers where permitted by law.
When required by law, Wild Pines may display required Seller identifying or contact information to consumers, subject to applicable statutory exceptions and protections.
If a qualifying Seller fails to provide, verify, update, or certify information required by applicable law, Wild Pines may provide the required notice and suspend future selling activity when required until compliance is restored.
Seller cooperation under this Section does not transfer Wild Pines' independent statutory obligations to the Seller. Wild Pines remains responsible for marketplace obligations that applicable law places directly on the marketplace.
For every listing, the Seller represents and warrants that:
Sellers must accurately describe the item actually being sold. Listings must not contain materially false, deceptive, incomplete, or misleading information.
Sellers must disclose material information reasonably relevant to a buyer's purchasing decision, including significant damage, defects, alterations, missing components, quantity, size, condition, authenticity, and other important characteristics.
Photographs should reasonably depict the actual merchandise unless the listing clearly and appropriately identifies another type of image.
Sellers may not manipulate listing information to conceal damage, misrepresent condition, create false scarcity, or otherwise deceive a buyer.
Sellers are responsible for photographs, descriptions, videos, trademarks, logos, graphics, and other material submitted with their listings.
Sellers represent that they own or possess sufficient rights to use submitted content and to grant Wild Pines the license described in the Terms of Service.
Wild Pines may remove content reasonably believed to violate intellectual-property rights, marketplace rules, applicable law, or the rights of another person.
Sellers may not list, sell, or deliver counterfeit merchandise or knowingly misrepresent the manufacturer, brand, origin, model, or authenticity of an item.
Wild Pines may request photographs, receipts, serial information, authentication records, purchase records, or other reasonable evidence concerning authenticity or ownership.
Suspected counterfeit listings may be removed while Wild Pines investigates. Confirmed counterfeit activity may result in cancellation, refunds, payout holds, account restrictions, or termination.
Sellers must comply with the Wild Pines Prohibited Items Policy.
Sellers may not list illegal goods, stolen property, counterfeit merchandise, products unlawful to sell, prohibited recalled goods, or other merchandise restricted by Wild Pines.
Wild Pines may restrict categories because of applicable law, product safety, carrier limitations, insurance requirements, fraud risk, payment-provider requirements, or marketplace safety.
A listing's technical ability to be submitted does not mean the item is permitted.
Sellers are responsible for ensuring that merchandise may lawfully be sold and for complying with applicable product-safety, labeling, and recall obligations.
Sellers may not knowingly sell merchandise subject to a recall or other prohibition that makes its resale unlawful.
Sellers must cooperate with legitimate safety investigations and recalls. Wild Pines may remove listings, cancel affected transactions, notify buyers, preserve relevant information, or take other reasonable safety measures.
Sellers generally determine their own item prices, subject to applicable law and Wild Pines marketplace rules.
Sellers may not engage in deceptive pricing, fraudulent price manipulation, transaction laundering, sham sales, or pricing intended to manipulate Wild Pines promotions or payment systems.
Wild Pines may separately charge buyers the Wild Pines Service Fee, shipping, taxes, or other amounts disclosed at checkout.
When a buyer completes a valid purchase, the Seller must fulfill the order unless cancellation is authorized under Wild Pines policy or required by law.
Sellers may not intentionally refuse valid orders because the item increased in value after purchase or because the Seller located a different buyer willing to pay more.
Repeated Seller cancellations, failure to fulfill orders, or listing unavailable inventory may result in account restrictions.
Sellers are responsible for packaging merchandise appropriately and tendering shipments to the applicable carrier within the timeframe required by Wild Pines.
When Wild Pines provides a prepaid shipping label, Sellers must use the correct label for the corresponding order and package unless Wild Pines expressly authorizes another method.
Sellers may not alter shipping labels, reuse labels, intentionally provide false package measurements or weight, manipulate tracking, or use a label for merchandise unrelated to the corresponding order.
Sellers are responsible for packaging items in a manner reasonably appropriate for their size, weight, fragility, value, and method of transportation.
Some merchandise sold as one listing unit or complete set may require multiple physical packages.
Sellers must use each package label generated for the order and must not omit a required parcel from a multi-package shipment.
An order may remain in a shipped or partially delivered state until all required packages have been delivered or otherwise resolved.
Carriers may audit package weight, dimensions, service level, packaging, address information, or other shipment characteristics.
To the extent permitted by law, a Seller may be responsible for additional carrier charges resulting from materially inaccurate package information supplied by the Seller or improper use of a shipping label.
Wild Pines may deduct or recover legitimate shipment adjustments attributable to the Seller from amounts otherwise payable to the Seller.
Wild Pines may rely on carrier and shipping-provider tracking events to determine shipment status, delivery status, transaction progress, and eligibility for release of Seller earnings.
Creating a shipping label alone does not establish that an item has been shipped. A shipment may remain in a preparing or pre-transit state until carrier movement is recorded.
Sellers may not manipulate tracking information or falsely represent that an item was shipped or delivered.
Wild Pines may display Seller earnings as pending, available, transferred, paid, held, reversed, or another applicable status.
A completed buyer payment does not necessarily make Seller proceeds immediately withdrawable.
Wild Pines may condition release of proceeds on transaction, fulfillment, tracking, delivery, dispute, fraud-risk, or other marketplace requirements.
Seller payout functionality may be provided through Stripe Connect or another payment provider selected by Wild Pines.
Sellers may be required to establish and maintain an eligible payout account and complete the payment provider's identity and compliance requirements.
Sellers are also subject to applicable terms imposed by the payment provider for their connected account and payout services.
Wild Pines does not control independent financial institutions' processing times, account holds, verification decisions, or other actions.
To the maximum extent permitted by law and payment-provider rules, Wild Pines may delay, hold, offset, reverse, or recover Seller proceeds reasonably connected to:
Wild Pines may maintain reasonable reserves when transaction history, dispute activity, fraud indicators, or other legitimate risk factors justify doing so, subject to applicable law.
Sellers agree to use the written transaction record in good faith during the buyer-and-seller self-resolution window described in the Buyer Protection and Refund Policy.
Sellers remain responsible for their listing, merchandise, packaging, fulfillment, and any direct arrangement they make with a buyer.
Sellers must not threaten, retaliate against, harass, or attempt to improperly pressure a buyer because the buyer reported a transaction issue.
A Seller may voluntarily approve a full refund through the transaction record during the self-resolution window. The Seller remains responsible for refund obligations imposed by applicable law or by the Seller's own disclosed return terms.
Sellers may offer additional discretionary return rights, provided those terms are clearly disclosed and do not conflict with mandatory law.
Wild Pines may provide transaction information to its payment processor when responding to a chargeback or payment dispute.
To the extent permitted by law, a Seller may be financially responsible for a chargeback, payment reversal, associated refund, or related loss resulting from the Seller's fraud, misrepresentation, failure to fulfill, prohibited merchandise, material policy violation, or other Seller-responsible conduct.
Wild Pines may calculate, collect, report, and remit sales, use, marketplace-facilitator, or similar transaction taxes when Wild Pines is legally required to do so.
Sellers remain responsible for Seller-specific federal, state, local, and other tax obligations that applicable law does not impose on Wild Pines, including applicable income taxes and maintaining records relating to the Seller's merchandise, cost basis, expenses, deductions, and other Seller-specific tax matters.
Sellers are responsible for determining whether they require licenses, registrations, permits, or other authorization arising from their own business activities or the particular merchandise they sell, except for registrations or obligations that applicable law places directly on Wild Pines.
Sellers must provide accurate tax information reasonably requested by Wild Pines or its payment providers for payment processing, information reporting, marketplace compliance, or other lawful purposes.
Wild Pines may maintain and provide transaction, payment, fee, shipping, payout, refund, or other marketplace records to Sellers and may perform information reporting when required by applicable law. Such records do not replace a Seller's responsibility to maintain the Seller's own legally required records or determine the Seller's individual tax obligations.
A Seller may receive limited information concerning a Wild Pines buyer when reasonably necessary to complete or support a marketplace transaction.
Buyer information obtained through Wild Pines may be used only as reasonably necessary to fulfill the applicable Wild Pines order, provide legitimate transaction support, process an authorized return, comply with applicable law, maintain legally required records, or for another purpose expressly authorized by Wild Pines or independently authorized by the buyer in accordance with applicable law.
Access to buyer information does not transfer ownership of that information to the Seller and does not make a Wild Pines buyer part of the Seller's independent customer or prospect database.
Sellers may not use information obtained through Wild Pines to:
Sellers may not use Wild Pines primarily to locate, identify, or communicate with buyers and then intentionally redirect those buyers to an outside sales channel to avoid Wild Pines checkout, marketplace charges, Buyer Protection, payment processing, transaction records, or other marketplace requirements.
Sellers may not solicit or direct Wild Pines buyers to purchase through:
Sellers may not ask or encourage buyers to cancel, abandon, refund, or otherwise avoid a Wild Pines transaction so that the same or a substantially related purchase can be completed outside Wild Pines.
Sellers may not use Wild Pines shipments primarily as advertising or customer-acquisition vehicles for an outside sales channel.
Sellers may not include business cards, promotional coupons, flyers, QR codes, external payment instructions, website addresses, or similar materials when their purpose is to encourage Wild Pines customers to bypass the Platform for future marketplace transactions.
Legitimate product documentation, manufacturer information, warranty information, safety instructions, care instructions, authenticity information, and materials reasonably associated with the merchandise itself are permitted.
Sellers may not structure transactions, communications, refunds, cancellations, shipping arrangements, payment requests, or other activity for the purpose of improperly avoiding Wild Pines charges, transaction systems, protections, or marketplace requirements.
Sellers may not request payment for a Wild Pines marketplace purchase through cash-transfer applications, wire transfer, cryptocurrency, gift cards, checks, direct card processing, cash, or another outside payment method for the purpose of bypassing Wild Pines checkout.
Sellers must communicate and interact with buyers, other sellers, Wild Pines personnel, service providers, and other marketplace participants in a respectful and professional manner.
Disagreement concerning a transaction, review, return, refund, shipment, reported transaction issue, or enforcement decision does not excuse threatening, abusive, discriminatory, or harassing conduct.
Sellers may not engage in:
Sellers may not unlawfully discriminate against, harass, exclude, or refuse marketplace service to a person based on a characteristic protected by applicable law.
Protected characteristics may include, as applicable, race, color, national origin, ancestry, religion, creed, sex, pregnancy, sexual orientation, gender identity or expression, disability, age, marital or familial status, military or veteran status, or another status protected by applicable law.
Sellers may not use listings, profiles, messages, photographs, or other Wild Pines functionality to promote unlawful discriminatory treatment or targeted harassment.
Nothing in this provision prevents a Seller from complying with a legitimate legal restriction that applies to a particular product or transaction.
Sellers may not:
Sellers may communicate professionally with buyers about legitimate transactions but may not manipulate reviews or marketplace feedback.
Sellers may not offer compensation in exchange for deceptive reviews, retaliate against buyers for truthful reviews, or coordinate false reputation signals.
Sellers may not threaten, harass, discriminate against, or improperly pressure a buyer because of a review or rating.
Sellers may not list merchandise or upload content that infringes copyrights, trademarks, patents, rights of publicity, or other proprietary rights.
Wild Pines may remove allegedly infringing material and may restrict or terminate repeat infringers as appropriate under applicable law and Wild Pines policy.
Sellers agree to cooperate reasonably with legitimate investigations involving fraud, stolen property, counterfeit merchandise, product safety, recalls, payment disputes, carrier claims, intellectual-property complaints, customer-data misuse, discrimination, harassment, or legal compliance.
Wild Pines may preserve and disclose relevant information when reasonably necessary to comply with applicable law, valid legal process, payment-provider requirements, or legitimate marketplace safety needs.
Wild Pines may remove listings, restrict selling privileges, delay payouts where permitted, suspend transactions, limit account functionality, or suspend or terminate a Seller account for material or repeated policy violations, fraud, safety risks, prohibited merchandise, legal requirements, attempts to evade enforcement, or other substantial marketplace risks.
Deliberate customer diversion, systematic off-platform solicitation, unauthorized commercial use of buyer information, serious harassment, unlawful discrimination, retaliation, fraud, or attempts to evade enforcement may result in significant account restrictions, including suspension or termination.
Where appropriate, restrictions may remain in effect while Wild Pines investigates a legitimate risk or unresolved transaction.
To the maximum extent permitted by applicable law, Seller agrees to defend, indemnify, and hold harmless Wild Pines Marketplace LLC and its members, managers, officers, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, penalties, costs, and reasonable attorneys' fees arising from or relating to Seller's merchandise, listings, misrepresentations, infringement, violation of law, product-safety obligations, recalls, fraud, misuse of buyer information, unlawful discrimination, harassment, misconduct, failure to fulfill a transaction, or material violation of this Agreement.
The limitation-of-liability provisions contained in the Wild Pines Terms of Service apply to Sellers and are incorporated into this Seller Agreement.
Nothing in this Agreement excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
The informal dispute-resolution, individual arbitration, class-action waiver, small-claims, governing-law, and related provisions contained in the Wild Pines Terms of Service are incorporated into this Seller Agreement.
Wild Pines intends these provisions to operate as one coordinated dispute-resolution framework rather than competing dispute clauses.
Closing or terminating a Seller account does not eliminate obligations relating to completed transactions, refunds, chargebacks, payment reversals, shipping adjustments, taxes, indemnification, intellectual property, investigations, customer information, privacy, anti-circumvention, disputes, or other obligations that by their nature survive termination.
In particular, account closure does not authorize a Seller to use buyer information previously obtained through Wild Pines for independent marketing, customer acquisition, customer-list building, retargeting, data resale, or another purpose prohibited by this Agreement.
Wild Pines may modify this Seller Agreement prospectively. Material changes will be communicated when required by applicable law.
Continued selling after an updated Agreement becomes effective constitutes acceptance where permitted by law.
Seller-support questions or reports concerning marketplace conduct may be submitted through Wild Pines Support.
