Wild Pines Marketplace
Last updated: October 2, 2026
These Terms of Service ("Terms") govern your access to and use of the Wild Pines Marketplace website, applications, marketplace services, payment functionality, shipping functionality, communications, and related services (collectively, the "Platform").
The Platform is operated by Wild Pines Marketplace LLC, a Colorado limited liability company ("Wild Pines," "we," "us," or "our").
By creating an account, accessing or using the Platform, listing an item, purchasing an item, selling an item, or otherwise using our services, you agree to these Terms and the policies incorporated into them. If you do not agree, you may not use the Platform.
Wild Pines provides an online marketplace that allows independent third-party buyers and sellers to find one another and complete transactions.
Unless Wild Pines expressly identifies itself as the seller of a particular item, Wild Pines is not the seller, manufacturer, distributor, owner, importer, or supplier of merchandise listed by third-party sellers.
Sellers are responsible for their merchandise, listings, descriptions, photographs, authenticity, ownership, legality, condition, safety, packaging, fulfillment, and compliance with applicable law.
Wild Pines may facilitate payments, shipping rates, prepaid shipping labels, tracking, communications, seller payouts, refunds, disputes, fraud prevention, and other marketplace services.
Providing those Platform tools does not make Wild Pines the seller, shipper, carrier, insurer, bailee, manufacturer, product expert, or representative of either user. Wild Pines does not take title to or possession of third-party merchandise merely by operating the Platform or facilitating payment or shipping tools. Payment and tax responsibilities follow the applicable payment flow and law.
Use of the Platform does not create an employment, partnership, joint venture, franchise, fiduciary, or agency relationship between Wild Pines and any user.
You must be legally capable of entering into a binding agreement and must satisfy any minimum-age requirements imposed by applicable law.
You must provide accurate, current, and truthful account information. You are responsible for maintaining the security of your account and for activity conducted through it, except to the extent applicable law provides otherwise.
You may not impersonate another person, create accounts using false information, evade an account restriction or suspension, manipulate verification systems, or use another person's financial or payment information without authorization.
Wild Pines may request identity, contact, tax, banking, business, or other information when reasonably necessary for payments, fraud prevention, marketplace safety, seller verification, or legal compliance.
By listing or selling an item, a seller represents that the seller:
Additional seller requirements are contained in the Wild Pines Seller Agreement.
Listings must accurately represent the item actually being offered for sale. Material defects, damage, missing components, alterations, or other facts that would reasonably affect a buyer's purchasing decision must be disclosed.
Wild Pines may remove, restrict, correct, or require changes to listings that violate our policies, applicable law, payment-provider requirements, carrier requirements, or marketplace safety standards.
Wild Pines does not guarantee that every listing, description, photograph, seller statement, or user-generated representation is accurate. Buyers should review listings carefully before purchasing.
Users may not list, purchase, sell, facilitate, or promote items or conduct prohibited by law or Wild Pines policy.
Prohibited merchandise includes categories identified in the Wild Pines Prohibited Items Policy and may include illegal goods, stolen property, counterfeit merchandise, recalled products, dangerous products, certain weapons, controlled substances, unlawful pharmaceuticals, fraudulent goods, and other restricted products.
Wild Pines may restrict additional products when reasonably necessary because of law, safety, insurance, carrier restrictions, payment-provider requirements, fraud risk, or marketplace integrity.
Payments may be processed using third-party payment infrastructure, including Stripe and Stripe Connect.
Buyers authorize Wild Pines and its payment providers to charge the payment method selected at checkout for the amounts disclosed before purchase, which may include merchandise, shipping, taxes, the Wild Pines Service Fee or other marketplace charges, and other properly disclosed amounts.
Wild Pines does not require users to provide complete payment-card numbers directly to sellers.
Wild Pines may charge buyers, sellers, or both for marketplace services. Applicable charges will be disclosed before the transaction or paid service is completed.
The Wild Pines Service Fee and other marketplace fees may help support payment processing, fraud prevention, customer support, transaction record administration, and Platform operations.
Wild Pines may change its fee structure prospectively. Material changes will be communicated when required by applicable law.
Users may not use Wild Pines primarily to locate another user and then intentionally move the resulting transaction outside the Platform to avoid marketplace charges, payment protections, shipping requirements, or other Wild Pines rules.
Wild Pines cannot provide its normal payment, shipping, dispute, or Buyer Protection services for transactions intentionally completed outside the Platform.
A seller balance displayed by Wild Pines does not necessarily mean that the funds are immediately available for withdrawal.
Seller proceeds may remain pending until applicable payment, fulfillment, delivery, dispute, fraud-risk, or other release requirements have been satisfied.
To the extent permitted by law and applicable payment-provider rules, Wild Pines may delay, hold, offset, reverse, or recover seller proceeds when reasonably necessary in connection with fraud or suspected fraud, chargebacks, refunds, cancellations, non-delivery, materially misrepresented merchandise, policy violations, legal requirements, negative payment balances, shipping disputes, intellectual-property claims, or other legitimate amounts owed in connection with a transaction.
Sellers are responsible for appropriate packaging and timely tender of sold merchandise to the applicable carrier.
When Wild Pines provides or requires a prepaid shipping label, the seller must use the appropriate label for the corresponding shipment unless Wild Pines authorizes another method.
Shipping rates and delivery estimates may be supplied by third-party carriers and shipping providers. Delivery dates are estimates unless expressly identified as guaranteed by the applicable carrier.
Wild Pines may provide promotional, discounted, subsidized, or free shipping for eligible transactions. Eligibility, limits, duration, and availability may vary by transaction or promotion.
Additional requirements are contained in the Wild Pines Shipping Policy.
Wild Pines maintains a separate Buyer Protection and Refund Policy describing the automated carrier-delivery, inspection, and self-resolution process for eligible transactions.
A reported issue freezes unreleased seller proceeds for the stated self-resolution window. The buyer may withdraw the issue, and the seller may voluntarily approve a full refund through the transaction record. If neither occurs, the automated process releases seller proceeds after that window.
Unless a seller expressly offers discretionary returns or applicable law requires otherwise, a buyer does not automatically have a right to return an item merely because the buyer changed their mind.
The standard process does not make Wild Pines a routine adjudicator of ordinary disputes about item condition, description, returns, or buyer's remorse. Nothing in this section limits non-waivable legal rights or a payment-provider process.
Users should use Wild Pines' transaction-resolution process when reasonably possible before initiating an external payment dispute.
Fraudulent, knowingly false, or intentionally duplicative chargebacks are prohibited.
To the extent permitted by law, a seller may remain financially responsible for a refund, chargeback, fraud loss, or payment reversal resulting from the seller's misrepresentation, failure to fulfill, policy violation, or other conduct for which the seller is responsible.
Wild Pines may calculate, collect, report, and remit sales, use, marketplace-facilitator, or similar taxes when Wild Pines determines that it is required to do so.
Sellers must provide accurate tax information when requested and remain responsible for income taxes and other seller-specific tax obligations not collected or remitted by Wild Pines.
Buyers remain responsible for taxes legally imposed on them that are not collected by Wild Pines.
Wild Pines may collect, verify, maintain, recertify, disclose, or otherwise process seller identity, banking, tax, business, and contact information when required by the INFORM Consumers Act or other applicable law.
Sellers must provide requested information accurately and promptly. Wild Pines may restrict or suspend sellers who fail to satisfy legally required verification, certification, disclosure, or related obligations.
Sellers may not knowingly list products that are unlawful to sell or subject to a recall that prohibits their sale.
Sellers are responsible for monitoring safety and recall obligations applicable to their merchandise and must cooperate with Wild Pines when a legitimate product-safety concern is identified.
Wild Pines may remove listings, cancel transactions, notify affected users, preserve relevant information, or take other reasonable action concerning safety risks or recalls.
Users retain ownership of intellectual property they lawfully own in content submitted to Wild Pines.
By uploading photographs, descriptions, videos, graphics, reviews, comments, or other content, you grant Wild Pines a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, distribute, and otherwise use that content as reasonably necessary to operate, secure, improve, and promote the Platform and applicable listings.
You represent that you possess the rights necessary to provide that license.
Wild Pines-owned software, designs, interfaces, graphics, text, branding, original photographs, documentation, and other proprietary material are owned by or licensed to Wild Pines and are protected by applicable intellectual-property laws.
Except as expressly permitted, users may not copy, scrape, republish, commercially exploit, reverse engineer, or create unauthorized derivative works from Wild Pines proprietary material.
Use of the Wild Pines name, logos, branding, or source identifiers does not grant ownership or trademark rights.
Users may not upload or sell content or merchandise that infringes another person's copyright, trademark, or other intellectual-property rights.
Wild Pines may remove allegedly infringing content and may restrict or terminate repeat infringers in accordance with applicable law and the Wild Pines Intellectual Property Policy.
Instructions for submitting copyright and other intellectual-property complaints will be maintained on the Intellectual Property Policy page.
Reviews, messages, reports, and other communications must be based on genuine marketplace activity and may not be used for fraud, harassment, threats, spam, manipulation, impersonation, or unlawful conduct.
Users may not buy, sell, manufacture, manipulate, or coordinate false reviews or marketplace reputation signals.
Except where expressly authorized by Wild Pines or applicable law, users may not use automated systems, bots, crawlers, scraping tools, data-mining systems, or similar technology to access, copy, extract, manipulate, overwhelm, or interfere with the Platform.
Users may not probe, bypass, defeat, or interfere with authentication, rate limits, security controls, access restrictions, or technical measures protecting Wild Pines or its users.
Users may not manipulate transactions, prices, shipping records, referrals, promotions, payment systems, account verification, seller metrics, or other Platform systems.
Wild Pines may investigate suspected fraud or abuse and may preserve or disclose information when reasonably necessary to protect users, enforce these Terms, comply with valid legal process, or satisfy applicable law.
Wild Pines may restrict, suspend, or terminate accounts for material or repeated violations of these Terms, fraud, safety concerns, legal requirements, payment risk, intellectual-property violations, prohibited merchandise, attempts to evade enforcement, or other substantial threats to the Platform or its users.
Where appropriate and legally permitted, Wild Pines may temporarily restrict transactions or payouts while investigating a legitimate risk or dispute.
Account closure does not eliminate payment, refund, chargeback, indemnification, dispute, intellectual-property, or other obligations that by their nature survive termination.
Wild Pines relies on independent third parties including payment processors, financial institutions, hosting providers, shipping carriers, shipping technology providers, authentication providers, and other service providers.
Wild Pines does not control independent third parties and is not responsible for their acts, omissions, outages, delays, or service changes except to the extent responsibility cannot legally be excluded.
By using Wild Pines, you consent to receive electronic communications necessary to administer your account and transactions, including order confirmations, shipping and tracking notices, security messages, policy notices, dispute communications, and other service communications.
Marketing communications are subject to applicable law and available email-preference or unsubscribe controls. Unsubscribing from marketing does not prevent Wild Pines from sending communications reasonably necessary to operate your account or complete transactions.
To the maximum extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis.
Wild Pines does not warrant that every third-party listing is accurate, that every buyer or seller will perform as expected, that every item will meet a user's expectations, or that the Platform will operate without interruption or error.
Wild Pines does not independently inspect, authenticate, test, warehouse, package, transport, insure, or guarantee third-party merchandise or third-party shipping performance unless it expressly says otherwise for a specific service.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, Wild Pines Marketplace LLC and its members, managers, officers, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, lost business, lost opportunities, lost goodwill, lost data, or similar losses arising out of or relating to the Platform, a listing, a transaction, another user, or these Terms.
Wild Pines operates a marketplace that facilitates transactions between independent buyers and sellers. Except to the extent expressly stated in an applicable Wild Pines policy, Wild Pines is not responsible for losses caused by a seller's product, a buyer or seller's conduct, inaccurate listing information, shipping-carrier conduct, product defects, product misuse, third-party services, or transactions or communications occurring outside the Platform.
Wild Pines does not assume responsibility for a third-party item or shipment merely because it displayed a listing, processed a payment, provided a shipping rate or label, displayed tracking, applied an automated hold, maintained a transaction record, or made seller proceeds eligible under its stated process.
To the maximum extent permitted by applicable law, the aggregate liability of Wild Pines Marketplace LLC and the other Wild Pines parties for all claims arising out of or relating to the Platform or these Terms will not exceed the greater of (a) $100 or (b) the total Platform fees actually paid by the claimant directly to Wild Pines during the 12 months immediately preceding the event giving rise to the claim.
For purposes of the preceding limitation, amounts paid for the purchase price of third-party goods, shipping charges, taxes, carrier charges, payment-processing amounts passed through to third parties, seller proceeds, refunds, and similar transaction amounts are not Platform fees paid to Wild Pines.
The limitations in this section apply regardless of the legal theory asserted and even if a remedy fails of its essential purpose, but only to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability, remedies, warranties, or consumer rights that cannot lawfully be excluded or limited.
To the maximum extent permitted by applicable law, sellers agree to defend, indemnify, and hold harmless Wild Pines Marketplace LLC and its members, managers, officers, employees, contractors, agents, and affiliates from third-party claims, damages, judgments, penalties, liabilities, costs, and reasonable attorneys' fees arising out of or relating to the seller's products, listings, misrepresentations, intellectual-property infringement, violation of law, product-safety or recall issues, fraud or misconduct, failure to fulfill a transaction, misuse of customer information, off-Platform circumvention, or material violation of these Terms or the Seller Agreement.
To the maximum extent permitted by applicable law, any user whose unlawful, fraudulent, intentionally wrongful, or materially unauthorized conduct causes a third-party claim against Wild Pines agrees to indemnify Wild Pines for losses and reasonable costs arising from that claim to the extent caused by that user's conduct.
Wild Pines is intended to be a safe, respectful, and professional marketplace. Users may not harass, bully, threaten, stalk, intimidate, extort, abuse, or deliberately target another user, Wild Pines personnel, or another person through the Platform.
Users may not engage in hate-based conduct, sexual harassment, unwanted sexual conduct, or unlawful discrimination. Where prohibited by applicable law, users may not refuse, interfere with, restrict, or condition marketplace participation or transactions because of a person's protected characteristics.
Protected characteristics may include, depending on applicable law, race, color, national origin, ancestry, religion, creed, sex, pregnancy, sexual orientation, gender identity or expression, disability, age, marital or familial status, military or veteran status, and other characteristics protected by applicable law.
Listings, profiles, usernames, messages, reviews, images, and other Platform content may not contain unlawful discriminatory requirements, targeted harassment, credible threats, or prohibited hate-based content.
Users may not retaliate against another person for making a good-faith report, participating in an investigation, asserting legal or contractual rights, requesting marketplace support, filing a permitted claim, or leaving an honest review consistent with Wild Pines policies.
Wild Pines may investigate suspected violations and may remove content, restrict features, cancel transactions where appropriate, suspend or terminate accounts, withhold or delay funds where legally permitted and reasonably necessary, or take other action consistent with these Terms, the Marketplace Rules, and applicable law.
Information about another user obtained through Wild Pines may be used only as reasonably necessary to complete, fulfill, support, document, or lawfully administer a Wild Pines transaction, or as otherwise permitted by the Privacy Policy and applicable law.
Unless the affected person has independently provided legally sufficient consent or another lawful basis exists, users may not use marketplace customer information to build an independent marketing database, send unrelated marketing communications, conduct advertising or retargeting, perform customer matching, sell or rent personal information, or otherwise commercially exploit information obtained through Wild Pines.
Users may not scrape, systematically export, compile, aggregate, or harvest buyer or seller information from the Platform for independent customer acquisition, competitive intelligence, advertising, or other unauthorized purposes.
Sellers may not use Wild Pines listings, messages, orders, packaging, inserts, QR codes, coupons, URLs, social-media information, telephone numbers, payment links, or other communications primarily to divert a buyer away from Wild Pines or avoid Wild Pines fees, protections, payment processing, or transaction records.
Legitimate product instructions, safety information, manufacturer documentation, legally required disclosures, warranty information, and materials reasonably necessary to use or maintain an item are not prohibited merely because they identify a manufacturer or other legitimate third party.
These restrictions survive completion or cancellation of a transaction and suspension or termination of an account to the extent necessary to protect customer information, Wild Pines' legitimate marketplace interests, and applicable legal rights.
Before either a user or Wild Pines commences arbitration, the complaining party must first provide the other party with an individualized written notice describing the nature and factual basis of the dispute, the specific relief requested, and information reasonably sufficient to identify the account or transaction involved.
A user may send an informal dispute notice to wild.pines@outlook.com with the subject line "Notice of Dispute." Wild Pines may provide a dispute notice to the email address associated with the user's account or through another legally permitted method.
After a compliant notice is received, the parties will have 30 days to attempt in good faith to resolve the dispute before arbitration may be filed. The parties may mutually agree to extend that period.
This informal process is intended to provide a genuine opportunity to resolve disputes efficiently. It does not prevent either party from seeking emergency relief when delay would materially prejudice a legally protectable right.
Please read this section carefully. Except for matters expressly excluded below, it requires disputes between you and Wild Pines to be resolved through binding individual arbitration rather than in court.
Except for eligible small-claims matters, claims for which applicable law prohibits mandatory arbitration, and requests for qualifying temporary or emergency judicial relief described below, any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, an account, a Wild Pines transaction, or the relationship between a user and Wild Pines that cannot be resolved through the informal dispute process will be resolved by binding arbitration.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement to the extent applicable.
Consumer arbitrations will be administered by the American Arbitration Association ("AAA") under the AAA Consumer Arbitration Rules and Mediation Procedures then in effect, as modified by these Terms and subject to applicable law. If the AAA determines that its Commercial Arbitration Rules or another AAA rule set properly applies to a non-consumer dispute, that applicable AAA rule set will govern.
The applicable AAA rules and current fee schedules are available from the AAA. Wild Pines will pay arbitration fees that applicable AAA consumer rules or applicable law require the business to pay. A user will not be required by these Terms to pay fees exceeding those permitted under applicable law or the applicable AAA consumer fee schedule.
Unless the parties agree otherwise or applicable law or AAA rules require another procedure, hearings may occur by video, telephone, written submissions, or at a reasonably accessible location determined under the applicable AAA rules.
The arbitrator may award any individual remedy or relief that would be available to the individual claimant under applicable law and that is within the arbitrator's authority. Judgment on an arbitration award may be entered in a court of competent jurisdiction.
If AAA is unavailable or declines to administer an arbitration despite the parties' compliance with this agreement, the parties will attempt in good faith to select a substitute nationally recognized arbitration provider. If they cannot agree, a court of competent jurisdiction may appoint an arbitration provider or arbitrator as permitted by applicable law.
A user may opt out of the arbitration agreement in Section 32 by sending a written opt-out notice to wild.pines@outlook.com within 30 days after the user first accepts these Terms.
The notice must clearly state that the user is opting out of the Wild Pines arbitration agreement and must include the user's full name, the email address associated with the Wild Pines account, and enough information for Wild Pines to identify the account.
An opt-out applies only to the arbitration agreement. All other provisions of these Terms remain in effect. Wild Pines will not retaliate against or deny marketplace access to a user solely because the user timely exercises the arbitration opt-out right.
To the maximum extent permitted by applicable law, users and Wild Pines agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, claimant, or class member in a purported class, collective, consolidated, or representative action or arbitration.
An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual's claim, except to the extent applicable law requires otherwise.
Nothing in this provision prevents participation in a settlement that resolves claims on an aggregated basis when the parties voluntarily agree to such a settlement.
If the AAA determines that multiple arbitration demands constitute a mass arbitration under its applicable rules, the AAA Mass Arbitration Supplementary Rules and applicable mass-arbitration fee schedule then in effect will apply in addition to the underlying AAA rules.
Nothing in this section authorizes class arbitration or converts individual claims into a class, collective, or representative action. Individual claims remain individual except to the extent the applicable AAA rules provide administrative procedures for efficiently managing qualifying coordinated filings.
Either party may bring an eligible individual dispute in a small claims court of competent jurisdiction instead of arbitration, so long as the matter remains within that court's jurisdiction and proceeds only on an individual basis.
Nothing in the arbitration agreement prevents either party from seeking temporary, preliminary, or emergency injunctive relief from a court of competent jurisdiction when such relief is legally available and reasonably necessary to prevent imminent or irreparable harm pending arbitration.
Wild Pines may also seek appropriate judicial relief concerning actual or threatened intellectual-property infringement, unauthorized access to the Platform, security attacks, misuse of Wild Pines systems, fraud, theft, or other circumstances for which applicable law permits judicial equitable relief.
These Terms are governed by applicable federal law and, to the extent state law applies and is not preempted, the laws of the State of Colorado, without regard to conflict-of-law principles.
This choice of law does not deprive a consumer of mandatory rights or protections that cannot lawfully be waived under the laws applicable to that consumer.
Wild Pines may modify these Terms prospectively. When required by applicable law or when a change materially affects users' rights, Wild Pines will provide appropriate advance notice before the change becomes effective.
Continued use of the Platform after the effective date of revised Terms constitutes acceptance where permitted by applicable law. Changes will not be applied retroactively when doing so would be prohibited by law.
Material changes to the arbitration agreement will be administered consistent with applicable law and will not be used to deprive a user of an arbitration opt-out right that the user previously and validly exercised.
Users may not assign or transfer their rights or obligations under these Terms without Wild Pines' prior written consent, except where applicable law provides otherwise.
Wild Pines may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or similar business transaction, subject to applicable law.
A failure by Wild Pines to enforce a provision of these Terms does not waive Wild Pines' right to enforce that provision or another provision later.
If a provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain effective, except where applicable arbitration law requires a different result.
These Terms, together with the policies and agreements applicable to a user or transaction, constitute the agreement governing use of Wild Pines.
Applicable incorporated policies may include the Privacy Policy, Seller Agreement, Buyer Protection Policy, Shipping Policy, Prohibited Items Policy, Intellectual Property and DMCA Policy, and Marketplace Rules.
Transaction-specific policies supplement these Terms. Wild Pines intends these documents to be interpreted consistently. No separate Wild Pines policy creates a conflicting dispute-resolution forum unless that policy expressly states that it supersedes the dispute-resolution provisions of these Terms.
If a seller is subject to the Seller Agreement, the Seller Agreement supplements these Terms with seller-specific obligations. If a direct conflict exists concerning a seller-specific operational obligation, the more specific seller provision controls that obligation, but the dispute-resolution provisions of these Terms control unless expressly stated otherwise.
Questions, support requests, and informal dispute notices may be submitted through Wild Pines Support.
